The website of the Colombian Coffee Growers Federation, www.federacindecafeteros.org, and www.cafedecolombia.com, including all their features and contents (hereinafter the “Official FNC Website”) is a service provided by the Colombian Coffee Growers Federation (hereinafter the “Provider”) for the general public, and all the content, information or software (hereinafter the “Content”) provided on and through the Official FNC Website shall be used exclusively under the strict observance of the following terms (hereinafter the “Terms of Use”).

Limited License: As a user of this Official FNC Website, you are guaranteed a non-exclusive, non-transferable, revocable and limited license to access and use the Official FNC Website and its Content under these Terms of Use. The Provider may terminate the license at any time in its sole discretion.
Limitations of Use: The Content of the Official FNC Website is only for personal use and not for commercial purposes. The user is not authorized to decompile, dismantle, lease, lend, sell, or reverse engineer the Content of this website, nor is the user permitted to transfer to any other party the license of access and use or create derivations of the Official FNC Website or its Content. Likewise, the user is not authorized to use any network control software or that of any other kind in order to determine the architecture of the Official FNC Website or extract information about its use, identities or users. The use of robots, spiders or any other type of software, automatic device or manual process in order to control or copy the website or its Content, without previous written authorization by the Provider, is prohibited. Intellectual Property Rights: The Official FNC Website does not confer any license or right, by implication, inference or other means, regarding copyright or any other intellectual or industrial property rights. By entering the Official FNC Website, the user accepts that both the Content and the Official FNC Website are protected by the copyright and intellectual property laws and decrees in Colombia. Links to the Official FNC Website: Links can only be established to the homepage of the Official FNC Website, provided that: a) all or part of the homepage of the Official FNC Website, the Terms of Use, the copyright notice, or other notices displayed on the Official FNC Website are not removed or hidden by macros or other functions; b) notice is given to (authorization is requested from) the Provider about said link through an email sent via the “Contact us” section of the Official FNC Website; and c) the link to the Official FNC Website is eliminated upon the Provider’s request. Content Use Authorization to the Provider: By uploading or sending material or content of any nature to be used on this Official FNC Website, the user grants (or guarantees that the owner of such material or content has expressly granted) to the Provider intellectual and industrial property rights and indefinite, general, free-of-charge, irrevocable and non-exclusive license to use that material or content, also conferring the right to contract, use, modify, adapt, publish, publicly reproduce or present, digitally present or translate, create derivative works and distribute such materials or incorporate them into any form, means, or technology known or to be known. The user in this act waives their possible legal actions against the Provider for alleged or real violation or illegal appropriation of their intellectual or industrial property rights in their communications.
Solicitations: The user is not authorized to distribute on or through the Official FNC Website contents or materials that contain ads, requests for goods, services or funds, or requests for third parties to become members of any company or organization without prior, express and written authorization by the Provider. However, in any interactive section of this Official FNC Website, where relevant, the user can: a) place next to their name, address and email, the URL of their own website or webpage, and b) recommend websites, goods or services provided that there are no commercial interests, and direct or indirect benefits are no received from such portal, webpage, product or service or from their recommendation. In no case shall a person or entity harm another person or entity with data collected from the Official FNC Website.
Errors and corrections: The Provider is not responsible for errors, viruses or other harmful components that the information available on the Official FNC Website may have, nor is it obliged to correct or clean it. In the same way, the Provider is not responsible for the temporary or permanent suspension of the service and/or access to the Official FNC Website. The Provider is not responsible for the content of the information available on or through the Official FNC Website nor for its veracity, accuracy, timeliness, or reliability. The Provider reserves the right to make, at any time, improvements or changes to the features, functionality or Content of the Official FNC Website.
Third-party content: Third-party content may be displayed on the Official FNC Website or remain accessible through links from the Official FNC Website. The Provider is not responsible for any infringement, error, legal contradiction, defamation, slander, offense, omission, falsehood, obscenity, pornographic material or profanity contained in the declarations, opinions, statements or any other form of content present in the contents of third parties posted on the Official FNC Website. The Provider does not assume the responsibility of storing or supporting the information of third parties. The user expressly declares to know that the information and opinions expressed in the content provided by third parties are not endorsed by the Provider nor do they necessarily reflect its thoughts.
Exclusion of guarantees: The Official FNC Website is presented as it is and according to its availability. The Provider does not grant any guarantee to the user, including but not limited to guarantees of commercialization, marketability, appropriateness and non-usurpation of rights. The Provider assumes no responsibility for any loss, damage, claim, impediment or harm, direct or indirect, that may result from or is related to 1) errors or omissions on the Official FNC Website and its Content, including but not being limited to technical inaccuracies and typographical errors; 2) third-party websites or contents that can be accessed directly or indirectly through links on the Official FNC Website, including, but not limited to, any error or omission in these; 3) the unavailability of the service provided by the Official FNC Website or any part thereof; 4) the use of the Official FNC Website, or 5) the use of any hardware or software relating to the Official FNC Website.
Disclaimer: Except for the responsibility that the Provider shall assume according to its position in the respective interactive section, the user acknowledges that the Provider will not be responsible for any losses, damages, claims, impediments or harms of any kind resulting from the use of the Official FNC Website and the interactive sections of the Official FNC Website or from any information or opinion that appears in or through an interactive section. The Provider is not liable for any specific, direct or indirect, incidental or consequential damages of any kind (including but not limited to legal fees) caused by, as a result of or related to the use of or inability to use the Official FNC Website or its Content. In the event that the foregoing disclaimer is prohibited, the obligation for damages caused by the Provider shall be limited to COP 100.00 (one hundred Colombian pesos with 0 cents).

Illegal Activities: The Provider reserves the right to investigate violations of the Terms of Use and take any action that it deems appropriate against whoever is liable, including but not limited to denouncing to competent agencies or third parties any activity deemed illegal or clandestine and to reveal any information necessary or useful for such agencies or persons related to personal data, email addresses, history, material sent, IP addresses and user traffic information.
Non-compliance: The Provider reserves the right to use any and all means provided by law to prevent, impede or repair the breach of these Terms of Use including, without being limited to, the right to block access to this Official FNC Website or to any other websites of the Provider and their features from a particular Internet address.
Applicable Legislation: By accepting these terms, the user accepts that the Terms of Use are governed and will be interpreted in accordance with the laws of the Republic of Colombia and current international treaties signed, and that any legal action arising from or related to these terms must be taken to the Colombian courts.
Modifications of Terms of Use: The Provider reserves the right to modify these terms at any time without prior notice. The updated versions of the Terms of Use shall appear on the Official FNC Website and be in force immediately from the moment they are displayed on it. The user is responsible for regularly reviewing these terms. The continuous and uninterrupted use of the Official FNC Website after such modifications constitutes their acceptance by the user.

No part of the information contained in this Official FNC Website may be reproduced or transmitted in any form or through any electronic or mechanical means, including copies, recordings or through any storage system, without the explicit and written permission from the General Directorate of Intellectual Property of the Colombian Coffee Growers Federation.
